He won a digital art competition two years ago and now expects to sell his masterpieces and make even more money than he makes as an executive.He’s ticked off because people think they can steal his works. That’s right. Just copy them, put them in frames and sell them on Etsy. He thinks he is entitled to protection from the U.S. Copyright Office. According to the office, he’s not.

The main ethical problem of AI-generated imagery

The ethical problem, recognized by the people who grant copyright in this country, is that this work is not the result of a human’s creative process. American copyright law, the U.S. Copyright Office argues, is based on a tradition of protecting creative humans going back hundreds of years. Here’s their recent finding:

I do not oppose the creative and humanitarian use of AI or any other technology.
The U.S. Copyright Office has come down squarely on the side of protecting creative people, not machines that steal from creative people, or people who creatively steal from machines that steal from creative people and then whine when they can’t make much money by stealing because other thieves are robbing them.Here’s a picture I recently generated from a text-to-image program:

I ordered it up to illustrate a story I wrote and published awhile ago. This took me less than a minute. It’s a picture of a busty, young girl with what were supposed to be elf ears, though they look more like Playboy Bunny ears.I do not oppose the creative and humanitarian use of AI or any other technology. I can’t edit a digital image without AI. The image that leads this story was edited with the help of AI. A doctor recently asked if it was OK with me to use his AI app to assist him in the process of taking notes during a meeting. I said, “Sure.”I oppose AI-generated imagery created for commercial purposes, by “prompt artists” who tell machines what pictures they’d like to see and produce them in seconds.When I have created AI images and posted them in some of my stories — those critical of AI — I have done so believing I was simply educating the public, and therefore not ripping anybody off in those instances.
I’ve posted a number of AI-generated images in my stories. I am not going to do it anymore. I’ve done it enough.
Now, I am not so sure.I am not going to post the busty-girl-with-rabbit-ears picture here and invite you to steal it, which I had planned to do when I started writing this article.Why? Because, as I stated above, AI-generated images created on Midjourney and other text-to-image generators consist of a mosaic of stolen images created by real artists and photographers.So, if I post that, somebody gets hurt.I have thousands of photos I’ve taken myself that I can use to illustrate my stories, and many of them have already been plastered all over the internet anyway, so I can use those as illustrations. I can also use public domain images.I am very tempted to re-post the image of Allen’s award-winning, AI-generated masterpiece and invite you to steal that. I won’t. Because if I do, somebody loses— the artists who were ripped off while the multi-million dollar AI industry stole their work, without any compensation and without their knowledge, in a blatant violation of copyright.However, Allen’s masterpiece is used as an illustration in the Gizmodo story linked above.Hint, hint.

Note:

I shot the image above on an IPhone X, which is the phone camera I used back in 2021 when I went to New Mexico. I edited it recently in PSExpress. I mention this because I can’t edit a digitally produced photo without the help of AI. This has been true for a few years, at least. This points up the need to clearly delineate between generative AI and the legitimate use of AI in the creative process.
